Eines der Schl\u00fcsselelemente ist dabei die Ermittlung einer Zone m\u00f6glicher Einigung zwischen den Parteien, die als ZOPA bezeichnet wird. Wenn die Kluft zwischen dem, was gefordert wird, und dem, was angeboten wird, zu gro\u00df ist, d. h. wenn es keine ZOPA zwischen den Parteien gibt, lohnt es sich theoretisch nicht, die Mediation fortzusetzen, und es geht darum, um den hei\u00dfen Brei herumzureden und die Zeit des anderen zu spielen. Die Schlussfolgerung, dass die Kluft zu gro\u00df ist, die Parteien kein ZOPA haben und die Mediation nicht in Frage kommt, ist nicht das, was die Parteien zu h\u00f6ren erwarten, vor allem wenn sie in der Mediation Potenzial sehen.  Im Kern geht es darum, zu verstehen, worum es bei dieser Kluft geht. Geht es um Ambitionen? Oder geht es vielleicht um den Wunsch einer Partei, die andere Partei irgendwie zu bestrafen? Um zu zeigen, wer das Sagen hat? Um etwas zu enth\u00fcllen, das vorher nicht ausgesprochen werden konnte? Der Moment, in dem der Grund gekl\u00e4rt wird, beeinflusst den Verhandlungstanz sehr stark und macht ihn immer rhythmischer. In realen Mediationskontexten hilft die Flexibilit\u00e4t des Prozesses nicht nur bei der Identifizierung von ZOPA, sondern auch bei der Heranf\u00fchrung der Parteien an sie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Caucus in der Mediation<\/h2>\n\n\n\n<p>Was ich als hilfreich empfinde, ist die Arbeit in den Fraktionen, um die Parteien nicht zu \u00fcberfordern, indem sie in Gegenwart des anderen Zugest\u00e4ndnisse machen und in dieser Hinsicht hohe Emotionen zeigen.<\/p>\n\n\n\n<p>Ein Mediator hat keinen Einfluss auf die Forderungen und Angebote der Parteien und beurteilt nicht, ob sie zu hoch oder zu niedrig sind. Ein Mediator kann jedoch ein gemeinsames Verst\u00e4ndnis daf\u00fcr schaffen, warum und wof\u00fcr ein bestimmter Geldbetrag gefordert\/angeboten wird. Manchmal ist das gr\u00f6\u00dfte St\u00fcck vom Kuchen, das man bekommt, hinterher nicht mehr zu bew\u00e4ltigen. Bei der Mediation geht es darum, nicht das zu bekommen, was man will, sondern das, was n\u00f6tig und machbar ist. Eine gute Frage, mit der man beginnen sollte, ist, wie die antragstellende Partei auf den geforderten Betrag gekommen ist. In meiner Praxis habe ich einmal die Antwort bekommen, dass das nicht meine Sache sei. Meine Aufgabe sei es, so die Partei, \"ihnen zu helfen, diesen Betrag zu bekommen\". Meine Frage war also nicht nur reine Neugierde. Um den Vermittlungsprozess wirksam zu unterst\u00fctzen, muss ich der anderen Partei erkl\u00e4ren, warum die antragstellende Partei diesen bestimmten Betrag fordert, und das kann ich nicht tun, ohne es zu wissen. Wenn eine Partei Millionenbetr\u00e4ge fordert und ihre Berechnungen nicht erkl\u00e4ren kann, wird die andere Partei diese Forderung kaum ernst nehmen. Je mehr Informationen die Gegenpartei durch einen Mediator \u00fcber die Zahlen erh\u00e4lt, desto gr\u00f6\u00dfer sind die Chancen, einen attraktiven Betrag zu erhalten, den die antragstellende Partei fordert.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fragen in der Wirtschaftsmediation<\/h2>\n\n\n\n<p>Nachfolgend sind die Fragen aufgef\u00fchrt, die ich verwende, wenn es sich um einen Fall der Wirtschaftsmediation handelt:<\/p>\n\n\n\n<p>1) Was bedeutet diese Zahl f\u00fcr Ihre Partei, und was bedeutet sie m\u00f6glicherweise f\u00fcr die andere Partei?<\/p>\n\n\n\n<p>2) Ich bin sicher, Sie wissen, worum es bei der Mediation geht, und deshalb sind Sie hier. Helfen Sie mir bitte zu verstehen, worum es bei diesem Umzug\/ dieser L\u00fccke geht?<\/p>\n\n\n\n<p>Es ist hilfreich, den Verhandlungsprozess zu visualisieren, um eine nat\u00fcrliche Entwicklung zu zeigen, bei der sich die Parteien von prim\u00e4r \"festen und nicht verhandelbaren\" Zahlen immer mehr ann\u00e4hern, wenn auch nicht einander, so doch mit Sicherheit einer Einigung. Der Einsatz visueller Techniken, die die Schritte der Parteien auf dem Flipchart oder der Tafel festhalten, motiviert sie, zu einem f\u00fcr beide Seiten akzeptablen Betrag zu kommen.<\/p>\n\n\n\n<p>Wenn Parteien in einer Sackgasse stecken und sich nicht bewegen wollen oder k\u00f6nnen, verwende ich eine Technik, die Klammern und einen visuellen Trick kombiniert. Ich teile die L\u00fccke durch die Durchschnittszahlen in Klammern (gr\u00fcn hervorgehoben) in zwei Teile: die linke Seite ist n\u00e4her an dem, was die antragstellende Partei fordert, und die rechte Seite zeigt, was die antwortende Partei anbietet. Sicher, Sie k\u00f6nnen eine feste Zahl dazwischen angeben, die hier $3.875.000 betr\u00e4gt. Aber selbst wenn man Elemente des bewertenden Ansatzes verwendet, ist es meiner Meinung nach wichtig, einen gewissen Spielraum zu lassen und den Parteien die M\u00f6glichkeit zu geben, zu entscheiden, welche genaue Zahl f\u00fcr beide akzeptabel ist. Die wahrscheinlichste Antwort ist die Option nahe der eigenen Seite (rot hervorgehoben).<\/p>\n\n\n\n<p>2) Wie sch\u00e4tzen Sie den Standpunkt der Gegenpartei zu Ihrer Option ein? Die wahrscheinlichste Antwort ist, dass sie sie nicht akzeptieren wird.<\/p>\n\n\n\n<p>3) Gibt es andere m\u00f6gliche Optionen? Und hier sehen die Parteien mindestens zwei davon: eine Option, die n\u00e4her an dem liegt, was die andere Partei zu bieten bereit ist\/fordert, und eine Zahl aus der Klammer.<\/p>\n\n\n\n<p>4) Welche Option m\u00f6chten Sie erkunden? H\u00f6chstwahrscheinlich ist die zweite Option in Klammern, die gr\u00fcn hervorgehoben ist, interessanter. Im Vergleich zu einer rot hervorgehobenen Option, die der anderen Partei nahe steht, ist sie f\u00fcr jede Partei n\u00e4her, was visuell erkennbar ist.<\/p>\n\n\n\n<p>5) Jetzt bin ich hier in deinem Zimmer, und die Macht liegt bei dir. Du kannst sehen, dass es Optionen zu erkunden gibt. Sie entscheiden, ob Sie sich bewegen oder nicht. Wie lautet deine Entscheidung?<\/p>\n\n\n\n<p>Es handelt sich dabei nicht um eine allgemeing\u00fcltige Technik, aber sie k\u00f6nnte unter bestimmten Umst\u00e4nden hilfreich sein, wenn z. B. der Widerwille einer Partei, sich zu bewegen, durch Ambitionen oder negative Emotionen motiviert ist. Die Technik hilft, sich von der emotionalen Seite der Verhandlung auf das Wesentliche zu konzentrieren. Die Visualisierung verdeutlicht die Verhandlungsphase und erleichtert sie bis zu einem gewissen Grad, da das verbale Pingpong meist nicht \u00fcber Worte hinausgeht. In Anbetracht der Tatsache, dass die Anzahl der Menschen auf der Welt, die visuell sind, zwischen 60% und 80% schwankt, sind visuell dargestellte Informationen viel effektiver und verst\u00e4ndlicher.
